Alleged underpayment of total loss vehicle claims by Progressive Auto Insurance in Colorado.

Progressive Direct Insurance Co. and Progressive Preferred Insurance Co. have agreed to a $15.24 million class action settlement for Colorado policyholders who had a total loss vehicle claim. The lawsuit alleged that Progressive underpaid claims by applying an improper projected sold adjustment to the actual cash value of vehicles. Individuals who made a first-party claim for property damage between April 12, 2019, and July 8, 2026 (for Progressive Direct) or between Dec. 19, 2021, and July 8, 2026 (for Progressive Preferred), and whose vehicle was determined to be a total loss based on a Mitchell report with a projected sold adjustment, may be eligible for a cash payment. The payment will be equal to 68% of the projected sold adjustment impact amount. The claim deadline is February 5, 2027.
