These Terms of Service govern your access to and use of ClaimPanda, including our website, account features, alerts, content, and any related products or services we make available. By using ClaimPanda, you agree to these terms.

In these terms, “ClaimPanda,” “we,” “us,” and “our” refer to the operator of claimpanda.com and any related services we provide.

If you do not agree to these terms, do not use the service.

ClaimPanda is an informational software product designed to help people discover, track, and organize potential settlement, recall, or consumer compensation opportunities.

ClaimPanda is not a law firm, is not your lawyer, does not provide legal advice, and does not create a solicitor-client, fiduciary, agency, or representative relationship with you. Nothing on ClaimPanda is legal, financial, tax, accounting, or professional advice.

ClaimPanda is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all representations, warranties, and conditions, express, implied, statutory, or collateral, including implied warranties and conditions of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, accuracy, or error-free operation.

We do not guarantee that the service will always be available, secure, accurate, complete, timely, or free from bugs, outages, delays, or harmful components.

Any payout amount, eligibility score, match confidence, recommendation, estimate, or similar output provided through ClaimPanda is for informational and product-experience purposes only. It is not a promise, guarantee, or binding representation of what you will recover.

Past settlements, average payouts, or historical claim data do not guarantee future outcomes. Real outcomes depend on facts, legal developments, administrator decisions, proof requirements, submission timing, deductions, and other variables outside our control.

ClaimPanda Premium may provide access to paid software features, including AI-generated settlement matches, personalized recommendations, premium match views, alerts, email notifications, and related tools. These features are informational only and are not legal, financial, tax, accounting, or professional advice.

AI matches and recommendations are generated using information available to us, information you provide, and automated systems. They may be incomplete, inaccurate, outdated, unavailable, irrelevant, or not suited to your circumstances. A match does not mean you qualify for a settlement, will be approved by a claims administrator, will meet proof requirements, or will receive any money.

Your payment for ClaimPanda Premium is payment for access to software features. It is not a payment for legal services, claim filing services, guaranteed eligibility, guaranteed approval, guaranteed settlement access, guaranteed claim submission, guaranteed payout, guaranteed refund, guaranteed return on investment, or guaranteed recovery of money.

We do not guarantee that Premium will find any settlement you are eligible for. We do not guarantee that any recommended settlement will remain open, that a claim form will be accepted, that a deadline will be accurate or met, that an administrator will approve your claim, or that any payment will be made to you.

Any estimated missed amount, claimable amount, payout amount, potential value, match ranking, or similar Premium output is only an estimate for product and informational purposes. You should not treat it as a promise, valuation, offer, legal opinion, or assurance that you will receive that amount or any amount.

Email alerts and other notifications are provided as a convenience only. We do not guarantee that alerts will be delivered, delivered on time, or include every relevant settlement. You remain solely responsible for reviewing official sources, confirming eligibility, tracking deadlines, and deciding whether to file any claim.

ClaimPanda may link to third-party websites, claim portals, administrators, courts, payment platforms, and other services. We do not control those services and are not responsible for their availability, content, security, privacy practices, or decisions.

Your use of third-party services is governed by their own terms and policies.

ClaimPanda and its branding, software, design, text, databases, graphics, and other content are owned by ClaimPanda or its licensors and are protected by intellectual property laws. Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the service for your personal, non-commercial use.

We may suspend, restrict, or terminate your access to ClaimPanda at any time, with or without notice, if we believe you have violated these terms, created risk for us or others, or used the service in a way that is unlawful, abusive, or technically harmful.

We may also modify or discontinue any part of the service at any time.

To the fullest extent permitted by law, ClaimPanda and its founders, officers, employees, contractors, affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or aggravated damages, or for any loss of profits, revenue, business, opportunity, goodwill, data, or expected savings, arising out of or relating to your use of or inability to use the service.

Without limiting the previous paragraph, we are not liable for missed deadlines, rejected claims, administrator decisions, court decisions, payment delays, payment failures, inaccurate third-party information, or any loss arising from your reliance on content or outputs generated by the service.

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the service or these terms will not exceed the greater of one Canadian dollar ($1) and the amount you paid us, if any, in the twelve months before the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless ClaimPanda and its founders, officers, employees, contractors, affiliates, licensors, service providers, and partners from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and legal fees arising out of or relating to your use of the service, your content or submissions, your violation of these terms, or your violation of any law or third-party rights.

If you purchase a paid subscription, premium feature, or other paid service, you agree to the pricing, billing frequency, renewal terms, cancellation terms, and checkout terms presented to you at the time of purchase. You are responsible for reviewing those terms before you pay.

Unless otherwise required by law or expressly stated by us in writing, fees are non-refundable once billed or paid. We do not provide refunds, credits, or price adjustments because you did not receive a payout, did not qualify for a settlement, received fewer matches than expected, missed a deadline, had a claim denied, disagreed with a recommendation, or were dissatisfied with the amount or quality of any result.

We may add, remove, modify, limit, suspend, or discontinue paid features at any time, subject to applicable law. Continued access to Premium features may require an active paid subscription in good standing.

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict of law rules. You agree that any dispute arising out of or relating to these terms or the service will be brought exclusively before the courts located in Alberta, Canada, and you attorn to the jurisdiction of those courts.

We may update these terms from time to time. If we make material changes, we may revise the effective date above, post the updated version on this page, and take additional steps where appropriate. Your continued use of ClaimPanda after updated terms take effect means you accept them.
