IR Tiki LLC, d/b/a Pineda Inn Bar & Grill, has agreed to a $120,000 settlement to resolve a class action lawsuit alleging failure to pay tipped staff the minimum wage required by the Florida Minimum Wage Act when a tip credit was applied to their hourly wage. Eligible individuals worked as tipped staff between April 2021 and August 2023, had a tip credit applied, and were not paid the minimum wage for non-tipped work. Class members can receive $2 per hour for non-tipped work performed during the class period under these conditions. The total fund is capped at $120,000, with potential pro rata adjustments if claims exceed this amount. The settlement also allows for an increase in the fund if more than 81 class members are identified.
