Top Line Restaurants Inc. and Reveille Management LLC, operators of Denny's restaurants in New York, have agreed to a $440,000 class action settlement to resolve claims of unpaid "spread of hours" wages. The New York Attorney General's office found that these companies failed to pay employees an extra hour of pay at minimum wage for days where their workday, including breaks and split shifts, exceeded 10 hours. Eligible employees who worked at one of the 23 New York locations between January 1, 2019, and April 30, 2026, and did not receive this pay are encouraged to file a claim.

Eligibility requirements

You may be eligible if you:

  • Current or former employees who worked at a Denny's restaurant in New York operated by Top Line Restaurants or Reveille Management between Jan. 1, 2019, and April 30, 2026.
  • Employees who worked at least one day where their total workday exceeded 10 hours (including breaks and split shifts).
  • Employees who did not receive additional "spread of hours" pay for those qualifying days.
