Johnson & Johnson has agreed to a $4.7 million class action settlement to resolve claims that it violated Illinois’ Biometric Information Privacy Act (BIPA) by collecting, storing, disclosing, and profiting from biometric facial geometry from its Neutrogena Skin360 app without first providing legally required written disclosures and obtaining written consent. The settlement benefits individuals who performed a Skin360 skin assessment using any version of the app, including Neutrogena Skin360, NeoStrata Skin360 or any Skin360 collaboration with another entity, via mobile or web application while in Illinois between December 9, 2019, and May 5, 2023. Johnson & Johnson has also agreed to delete any images obtained during skin assessments and maintain a BIPA-compliant user notice and written consent mechanism going forward. The deadline to file a claim is November 25, 2026.
