Johnson & Johnson Consumer Inc., now known as Kenvue Brands LLC, has agreed to a $4.7 million class action settlement to resolve claims that it violated Illinois’ Biometric Information Privacy Act (BIPA). The lawsuit alleges that the company collected, stored, disclosed, and profited from users' biometric facial geometry through the Skin360 platform without providing required written disclosures or obtaining written consent. Consumers who performed a Skin360 skin assessment using any version of Skin360 (including Neutrogena Skin360 and NeoStrata Skin360) while in Illinois between December 9, 2019, and May 5, 2023, may be eligible to file a claim for a pro rata cash payment from the settlement fund. The settlement also requires Kenvue to delete collected images and implement new privacy policies.
