About this settlement

Allegations that Merrill Lynch paid insufficient interest rates on clients' cash balances in retirement and advisory accounts.

Merrill Lynch has agreed to pay $39 million to settle a class action lawsuit alleging that it paid brokerage clients close-to-zero interest rates on cash in retirement accounts instead of market rates. This settlement is in addition to a $25 million penalty from the SEC in January 2025 for similar issues in advisory accounts. The preliminary settlement was filed in Manhattan federal court and requires court approval. The lawsuit covered holders of Merrill Edge online accounts between December 15, 2016, and March 15, 2020, who allegedly received interest rates of 0.05% to 0.14% while other brokerages paid around 2%. Merrill Lynch denies wrongdoing.
