Allegations that Kroger did not properly consider savings club prices when reporting prescription drug prices to insurers, potentially causing insured customers to overpay.

Kroger has agreed to a $17 million class action settlement to resolve claims that it failed to properly account for its savings club prices when reporting usual and customary prescription drug prices to insurers. This alleged practice may have led insured customers to pay more for their prescriptions than they should have. Individuals who paid for prescription drugs at Kroger pharmacies using insurance between December 9, 2018, and August 23, 2026, may be eligible to file a claim for a pro rata cash payment. The claim deadline is December 21, 2026. Proof of purchase is required for claims of $8,000 or more.

You may be eligible if you:

• Individuals residing in the United States or its territories.
• Individuals who paid, in whole or in part, for one or more prescription drugs from Kroger or its affiliates.
• Individuals who used prescription insurance benefits when filling qualifying prescriptions.
• Purchases must have occurred between December 9, 2018, and August 23, 2026.
