A class action alleges Home Depot charges customers more at the register than the price shown on the shelf, with some items allegedly ringing up 10 to 40 percent higher.
Allegations that Home Depot charged customers more at checkout than the price displayed on the shelf.
Plaintiff Hazel Cabanlit filed a class action against Home Depot on February 27, 2026 in the U.S. District Court for the Northern District of Illinois. The complaint alleges that Home Depot's shelf tags understate what shoppers actually pay, with some items ringing up roughly 10 to 40 percent above the advertised shelf price, and that this misleads customers who rely on shelf pricing to compare products. The lawsuit asserts claims under the Illinois Consumer Fraud Act and other consumer protection and false advertising laws, and seeks to represent a nationwide class of Home Depot shoppers. Home Depot moved to dismiss in May 2026 and no ruling has been reported. This case is separate from a 2024 civil enforcement action in which Home Depot paid $1.9 million to Los Angeles County over similar pricing complaints; that money went to penalties, not customers. No class has been certified and no settlement has been reached.
