A certified Canadian class action alleges Home Depot shared the email addresses and purchase details of customers who asked for electronic receipts with Meta, without their consent.
Allegations that Home Depot of Canada shared e-receipt customers' email addresses and purchase details with Meta without valid consent.
Hvitved v. Home Depot of Canada Inc. is a certified privacy class action covering residents of Canada, outside Quebec, who gave their email address at a Home Depot store to receive an electronic receipt between January 1, 2018 and October 31, 2022. The lawsuit alleges that Home Depot sent those email addresses, together with the amount and type of each purchase, to Meta, which used the data to measure and target Facebook advertising. A 2023 investigation by the Office of the Privacy Commissioner of Canada found that Home Depot had not obtained valid consent for the sharing, and Home Depot estimated close to seven million customer emails were involved before it stopped the practice in October 2022. The British Columbia Supreme Court certified the privacy claims in January 2025, and on February 4, 2026 the British Columbia Court of Appeal dismissed Home Depot's appeal, leaving the certification in place. The case is proceeding toward trial. No settlement has been reached and there is no claim process yet.
