BNBuilders Inc. has agreed to a $5 million settlement to resolve a class action lawsuit alleging violations of the Employee Retirement Income Security Act (ERISA). The lawsuit claims that BNBuilders and other defendants breached their fiduciary duties by selling the company to its Employee Stock Ownership Plan (ESOP) at an inflated price. Vested participants in or beneficiaries of the BNBuilders ESOP between December 23, 2021, and December 31, 2025, may be eligible to claim a share of the settlement. While most eligible class members will receive an automatic pro rata cash payment, those who prefer a direct rollover to a qualified retirement account must submit an online or PDF rollover form by November 25, 2026.
