Allegations that Aviva and CDSPI cancelled the right to increase pandemic coverage under business interruption insurance policies and rejected policyholders' requests to do so.

This class action involves business interruption insurance policies offered by Aviva Insurance Company of Canada, Aviva General Insurance Company of Canada, and Aviva Canada Inc. (collectively, Aviva) and sold by CDSPI Advisory Services Inc. to dentists and dental corporations. The lawsuit alleged that the right to increase pandemic outbreak coverage was cancelled and requests to do so were rejected. A partial settlement was reached between CDSPI and the representative plaintiff, which the Ontario Court of Appeal has upheld, dismissing Aviva's appeal to stay the proceedings.
