Acceptance of these terms
These Terms of Service govern your access to and use of ClaimPanda, including our website, account features, alerts, content, and any related products or services we make available. By using ClaimPanda, you agree to these terms.
In these terms, “ClaimPanda,” “we,” “us,” and “our” refer to the operator of claimpanda.com and any related services we provide.
If you do not agree to these terms, do not use the service.
What ClaimPanda is and is not
ClaimPanda is an informational software product designed to help Canadians discover, track, and organize potential settlement, recall, or consumer compensation opportunities.
ClaimPanda is not a law firm, is not your lawyer, does not provide legal advice, and does not create a solicitor-client, fiduciary, agency, or representative relationship with you. Nothing on ClaimPanda is legal, financial, tax, accounting, or professional advice.
- We do not guarantee that any settlement, recall, or claim opportunity shown on ClaimPanda is available to you.
- We do not guarantee that you are eligible for any claim, that you will receive compensation, or that any estimate displayed by the service will match a real-world outcome.
- We do not control courts, claims administrators, defendants, payment processors, or third-party websites involved in any claim process.
Eligibility and accounts
- You must be legally capable of forming a binding contract to use ClaimPanda.
- You must provide accurate, current, and complete information when creating an account and using the service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must promptly notify us if you suspect unauthorized use of your account.
Your responsibilities
- You are solely responsible for reviewing official settlement notices, administrator websites, court materials, and filing instructions before taking action.
- You are solely responsible for meeting deadlines, confirming eligibility, providing truthful information, and keeping copies of your own records and submissions.
- You are responsible for ensuring that any information you submit through ClaimPanda or through a linked third-party site is accurate and lawful.
- You must not rely on ClaimPanda as your only source of time-sensitive legal or compensation information.
No guarantees or warranties
ClaimPanda is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all representations, warranties, and conditions, express, implied, statutory, or collateral, including implied warranties and conditions of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, accuracy, or error-free operation.
We do not guarantee that the service will always be available, secure, accurate, complete, timely, or free from bugs, outages, delays, or harmful components.
Estimates, results, and claim information
Any payout amount, eligibility score, match confidence, recommendation, estimate, or similar output provided through ClaimPanda is for informational and product-experience purposes only. It is not a promise, guarantee, or binding representation of what you will recover.
Past settlements, average payouts, or historical claim data do not guarantee future outcomes. Real outcomes depend on facts, legal developments, administrator decisions, proof requirements, submission timing, deductions, and other variables outside our control.
Third-party services and links
ClaimPanda may link to third-party websites, claim portals, administrators, courts, payment platforms, and other services. We do not control those services and are not responsible for their availability, content, security, privacy practices, or decisions.
Your use of third-party services is governed by their own terms and policies.
Prohibited conduct
- Using ClaimPanda for unlawful, fraudulent, deceptive, abusive, or harmful purposes.
- Attempting to interfere with the integrity, performance, or security of the service.
- Scraping, reverse engineering, copying, or redistributing substantial portions of the service or content except as permitted by law.
- Impersonating another person or submitting false or misleading claim information.
- Using automated means to access the service in a way that imposes an unreasonable load or bypasses security controls.
Intellectual property
ClaimPanda and its branding, software, design, text, databases, graphics, and other content are owned by ClaimPanda or its licensors and are protected by intellectual property laws. Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the service for your personal, non-commercial use.
Suspension and termination
We may suspend, restrict, or terminate your access to ClaimPanda at any time, with or without notice, if we believe you have violated these terms, created risk for us or others, or used the service in a way that is unlawful, abusive, or technically harmful.
We may also modify or discontinue any part of the service at any time.
Limitation of liability
To the fullest extent permitted by law, ClaimPanda and its founders, officers, employees, contractors, affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or aggravated damages, or for any loss of profits, revenue, business, opportunity, goodwill, data, or expected savings, arising out of or relating to your use of or inability to use the service.
Without limiting the previous paragraph, we are not liable for missed deadlines, rejected claims, administrator decisions, court decisions, payment delays, payment failures, inaccurate third-party information, or any loss arising from your reliance on content or outputs generated by the service.
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the service or these terms will not exceed the greater of one hundred Canadian dollars (C$100) and the amount you paid us, if any, in the twelve months before the event giving rise to the claim.
Indemnity
You agree to defend, indemnify, and hold harmless ClaimPanda and its founders, officers, employees, contractors, affiliates, licensors, service providers, and partners from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and legal fees arising out of or relating to your use of the service, your content or submissions, your violation of these terms, or your violation of any law or third-party rights.
Paid features
If ClaimPanda introduces paid subscriptions, premium features, or other paid services, additional pricing and billing terms may apply. Unless otherwise required by law or expressly stated by us in writing, fees are non-refundable once billed or paid.
Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict of law rules. You agree that any dispute arising out of or relating to these terms or the service will be brought exclusively before the courts located in Alberta, Canada, and you attorn to the jurisdiction of those courts.
Changes to these terms
We may update these terms from time to time. If we make material changes, we may revise the effective date above, post the updated version on this page, and take additional steps where appropriate. Your continued use of ClaimPanda after updated terms take effect means you accept them.
